On July, 31, 2019 the FCC released its monthly Public Notice containing its decisions related to requests for review, requests for waiver, and petitions for reconsideration.
The FCC granted appeals pertaining to the following issues:
- Considering All Bids Submitted
- Contract Requirement
- Cost-Allocation
- Cost-Effectiveness
- Eligible Services
- Granting Additional Time to Respond to USAC’s Request for Information
- Late-Filed FCC Form 471 Applications Filed within 14 Days of the Close of the Window
- Ministerial and/or Clerical Errors
- Price as Primary Factor – Applicant Selected Lowest-Cost Provider
- Timely-Filed Appeal
- USAC Error in Posting Revised FCC Form 470
- Waiver of Appeal Deadline
- Waiver of Service Delivery Deadline
- Waiver of Special Construction Service Delivery Deadline
USAC must now complete its review of the applications and issue a funding commitment or a denial based on a complete review and analysis, no later than 90 calendar days from the release date of this Public Notice.
The FCC denied appeals pertaining to the following issues:
- Failure to Satisfy Debt/Red Light Rule
- Invoice Deadline Extension Requests
- Late-Filed FCC Form 471 Applications
- Untimely Filed Appeals or Waiver Requests
